By accessing or using the OptiWork.ai website, services, or AI agents (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Services

OptiWork.ai provides AI consulting, process automation, and custom AI agent development services. We deliver software solutions that automate business tasks using Large Language Models (LLMs) and other technologies.

3. User Responsibilities & Acceptable Use

You agree NOT to use our services to:

• Generate content that is illegal, harmful, threatening, abusive, or defamatory.
• Attempt to reverse engineer, decompile, or extract the source code or model weights of our agents.
• Use the service for high-risk activities where failure could lead to death, personal injury, or environmental damage.
• Input sensitive Personal Health Information (PHI) or Payment Card Industry (PCI) data unless explicitly authorized in a separate BAA or agreement.

To the maximum extent permitted by law, OptiWork.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service; and
• Unauthorized access, use, or alteration of your transmissions or content.

In no event shall OptiWork.ai's aggregate liability exceed the amount you paid the company for the service in the past six (6) months.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. OptiWork.ai makes no representations or warranties of any kind, express or implied, regarding the accuracy, reliability, or completeness of any AI-generated output.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
